BOOKING TERMS & CONDITIONS

Please read the following carefully, these conditions must be understood as well as further expectations and procedures when booking with Michael Thornton (as all bookings unless otherwise stated fall under these conditions when booking the photographer, Michael Thornton. Feel free to message me on any questions you may have before scheduling a shoot. Absolutely no session is confirmed until a contract is signed and retainer is received by the photographer, Michael Thornton.

COPYRIGHT & USAGE

All photographs and footage are and shall remain the sole intellectual property of the Photographer in accordance with United States Copyright Laws. The Client hereby waives any rights to intellectual property ownership, monetization, or reproduction of the images and footage created by the Photographer, with exception of the terms of any formal written releases provided to the Client by the Photographer.

The Photographer does grant the Client usage of the photographs for personal and promotional use only. This includes, but not limited to: uploading to personal websites, submissions for potential work or representation, uploads to social media/ industry related websites (LinkedIn, Facebook, etc.), and event promotional material and displays. The client may also get physical prints of the digitals if he/ she wishes to. Photographs may not be sold or used for commercial purposes by the client or any 3rd party without consent from the photographer (This includes but isn’t limited to paid subscription sites such as Patreon, Etsy, Skilshare, etc.).

RETAINERS AND RESERVED TIME

A non-refundable, retainer equal to half of the total amount of the session is required to secure any booking. I currently accept payment through “Venmo”, “PayPal”, most major credit cards and apple pay. This is a non-refundable retainer, showing that the client is serious about booking the shoot. The second half of the payment shall be received the day of the shoot.

RESCHEDULING & CANCELLATIONS

If the client needs to reschedule their session it must be done at least 3 days prior to the scheduled date to avoid a forfeiture of their deposit. If the client is unable to put in their request before the shoot day, a $100 rescheduling fee may be paid to avoid losing deposit completely. Cancelled sessions will result in a forfeiture of their deposit.

WEATHER

Due to the unpredictable nature of the weather, it might be necessary for the photographer to postpone an outdoor headshot session if conditions on the day (or forecasted in advance) render it impossible for a shoot to go ahead. Alternative dates will then be suggested and agreed between the photographer and client(s), and the fees already paid will be valid for the rearranged date. In some instances, inclement weather may mean that some or all photography needs to take place indoors. The photographer will still make all reasonable efforts to meet the requirements agreed with the client(s), but the photographer will not be liable for any photographs unobtainable because of the restrictions of having to shoot inside.

FORCE MAJEURE

The photographer will endeavor to reschedule or put the client(s) in touch with another photographer in the unlikely event he is unable to conduct the photoshoot session due to any cause beyond his reasonable control e.g. sudden illness, injury, victim of crime, flooding etc. In the event of cancellation by the photographer, or in the unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.

PRICING

Pricing is always subject to change, no shoot or final session price is confirmed until a retainer is received by the photographer, Michael Thornton.

ALL sessions (this includes any deliverables) are subject to a 6% tax.
